The Clowns Are Still Running the Circus

New York still wants to sue gun manufacturers…


Maybe I am not as bright as my Psychology Professors once observed!


A couple of years ago, with the stroke of his pen, President Bush signed the Protection of Lawful Commerce in Arms Act.  The signing of this law was supposed to bring to an end, frivolous lawsuits brought by liberal city Mayors against the gun manufacturing industry. These grandstanders said it was the gun industry’s fault, that we have so many murders in the United States. Of course, that is stretching logic, just a wee bit too far. Yet, it didn’t stop these haters of the 2nd Amendment from pursuing this reckless course of action!


When the President signed the Protection of Lawful Commerce in Arms Act, I was one of many who shouted, “Hallelujah!” Our jubilation was short lived, because some arrogant city mayors continued with business as usual. They found equally arrogant judges who were willing to hear their ridiculous arguments against the gun industry. New York City is one of the cities that has told the President that they are “going to do whatever the hell they want to do,” and to hell with the Protection of Lawful Commerce in Arms Act!


Here is where I am questioning my intellect. I thought that once the President signed this bill, “Game Over.” I thought that judges had to follow the law, “not make the law.” My wife has accused me of being “Too Logical.”


A federal appeals court in New York City listened to two arguments:


* Should the President’s signing of the Protection of Lawful Commerce in Arms Act ended these type of lawsuits?


* Is the law signed by the President, “Lawful”


I can answer the first part of the anti-gunners question. Yes, when the President affixed his “John Hancock” to this law, he put the skids of “All Frivolous Lawsuits Against Gun Manufacturers.” End of Story! I believe the federal court can entertain arguments regarding the legitimacy of such a law. However, “No Court” can take it upon itself and say, “Screw Bush,” I’m going to still listen to these bogus type of lawsuits. Judges advocating this type of thinking are inviting anarchy! How can they sit and lecture us about obeying the law, when they are in violation of a legal statute?


New York corporation counsel, Michael Cardozo is of the opinion that Congress overstepped its legal authority by passing the Protection of Lawful Commerce in Arms Act. Personally, I don’t give a damn what Cardozo thinks. It is what the courts will ultimately have to say on the matter that is of importance to me. Cardozo said something that is unbeleivable. He said, “There is a war on the judiciary here.” A war on the judiciary? How about a war on common sense? We all know that it is people like Mayor Bloomberg, and yes, Rudy Giuliani who attempted to do an end run around the 2nd Amendment by suing gun manufacurers. Memo to Michael Cardozo: Judges interpret the law, not make them!” Stop your whining!


It is incumbent upon every judge in this country who is faced with these ridiculous lawsuits against the gun industry, to recuse themselves: That is until this law is ruled unconstitutional, or constitutional. Until then, the law stands. It is as simple as that.


An attorney representing the gun industry, said it was unfair to blame gun manufacturers for crimes committed “with its products.” That makes sense. We don’t see the anti-gun zealots running to the courts suing car manufactuers for the thousands of lives taken by motor vehicles every year. By the way, more people die from car accidents than do from guns. The knife industry is not being sued because someone was stabbed to death by a criminal wielding a knife.


The gun grabbers agenda is quite clear. These people will stop at nothing to strangle, and eventually kill the 2nd Amendment. I would like to know, where was the Justice Department during the proceedings in New York City? This is a “Federal Law” that was signed by the President, so why no representation from Justice?


Our culture is slowly being trampled under foot by maverick judges, who are seeking to redefine who we are as a people. U.S. District Judge Jack B. Weinstein is one of these maverick judges. He is the arrogant jackass who is thumbing his nose at the Protection of Lawful Commerce in Arms Act.


Now, “Lord Weinstein” is not saying when he will rule on the city’s request to proceed with the nonsense of suing gun manufacturers. Do not be surprised if “Lord Weinstein” comes down on the side of the city.


Rudy Giuliani who groveled before the National Rifle Association on Friday, is responsible for creating this “Frankenstein.” Now, he is saying maybe he went too far in trying to protect his city.


My response? Hey Rudy, “You Are A Dollar Short, And A Day Late.” Tell it to someone who cares!
